sound recording copyright issues

The use of recorded music in podcasts is very strictly limited by copyright and royalties.  Fair use guidelines as they relate to recorded music are to be interpreted very narrowly.  The law and judicial interpretation of the law are very complex and several recent court cases (e.g., Napster, .  Simply put, unless you see explicit permission to use the recording (i.e., as expressed by the copyright holder) or get permission to use a sound recording or even a clip or sample or part of a sound recording, DO NOT USE IT! Also, copyright laws vary from country to country so be mindful of where you are getting any music and the copyright laws of that country.  As noted in the U.S. Copyright Office Fair Use Basics "The safest course is always to get permission from the copyright owner before using copyrighted material."
